Bibb County Arrest Warrants

Per Ala. R. Crim. P. 3.1, a judge or magistrate in Bibb County will immediately issue an arrest warrant upon the return of an indictment or upon finding probable cause that a defendant has committed a crime. They can issue multiple arrest warrants on the same complaint or indictment. An arrest warrant must contain the following information (Ala. R. Crim. P. 3.2):

  • The signature of the magistrate, judge, circuit judge, circuit clerk, or any other designated officer.
  • The defendant's name (if known)
  • An identifying description of the defendant if the name is unknown
  • A statement of the offense with which the defendant is charged.
  • A command that the defendant be arrested and brought before the issuing judge or magistrate. If the issuing judicial officer is unavailable, the defendant can be brought before the nearest or most accessible district, circuit judge, or magistrate in the same county.

Per Ala. R. Crim. P. 3.3, all arrest warrants issued in Bibb County must be directed to and may be executed by any law enforcement officer in Alabama. These warrants are always executed by the arrest of the defendant. After executing an arrest warrant, the officer must endorse the manner and date of the execution and their name on the warrant. The officer must also return the arrest warrant to the court clerk specified in it.

Do Bibb County Arrest Warrants Expire?

No. Any arrest warrant issued in Bibb County remains active until it is served. The law enforcement officer who executes the arrest warrant will jail the defendant until they make bail. However, if the defendant committed a capital offense, they must go through the trial proceedings while incarcerated.
