How Does the Alabama Municipal Court Work?

Alabama Code Title 12, Chapter 14 grants municipalities within Alabama the legal authority to create Municipal Courts to oversee cases involving ordinance violations. Trials held in these courts are heard by a judge, without a jury, and their final decisions can be appealed in the state’s Circuit Courts.

Alabama has over 300 Municipal Court judges in its court system. Municipal Court judges are appointed by the governing body of the municipality of the court. Appointments can either be full-time or part-time. Full-time judges may serve successive terms of four years, while part-time judges may serve consecutive terms of two years. In municipalities where there is more than one judge, a presiding judge is designated by the mayor.

Only individuals that are licensed to practice law in the state of Alabama are eligible for appointments as Municipal Court judges. In the event of a vacant Municipal Court position, the municipal governing body will appoint a replacement judge to fill the position.

Alabama Municipal Courts have general jurisdiction over matters that involve municipal ordinance violations and traffic infractions. Municipal Courts also have jurisdiction over certain misdemeanor offenses. In cases where the crimes violate both state and municipal laws, Municipal Courts share jurisdiction with Alabama District Courts. The time a court case takes in an Alabama Municipal Court depends on the type of case and the municipality where the violation occurred. However, defendants found guilty but wish to appeal the court’s decision must file the appeal not later than 14 days after the sentence.

Copies of Alabama Municipal Court records can be obtained by contacting the office of Municipal Clerk at the Municipal Court, where the case in question was heard. The payment of a fee may be required before these records can be obtained.
